NJ tax refund reduced or offsetSOIL and FOIL debts, return mismatches, and missing results

New Jersey reduces or diverts a refund for one of four reasons: a return detail that does not match the Division’s records, a manual review, a debt collected through a set-off program, or a check the Postal Service returned. Wasserman Accounting CPAs finds which one applied, contacts the agency holding the money, and corrects the return.

NJ refund offsets and reductions in three points

01

New Jersey’s SOIL program can apply your income tax refund and property tax relief payments to unpaid New Jersey tax, traffic fines, child support and other government debts; the Division writes to you, and you have 35 days to contact the agency.

02

The Division cannot release an offset refund until the agency reports the debt paid, and the IRS can take your federal refund for a New Jersey tax debt under FOIL.

03

Wasserman Accounting CPAs reads the offset notice, disputes or settles the debt with the agency, and fixes the return behind a reduced refund.

A CPA or EA reads your offset notice and tells you which agency to call and what to send. Call 609-281-8096 or send the contact form.

Why is a NJ tax refund reduced or not paid?

The Division reduces, holds or diverts a refund for one of four reasons.

  1. 01Return details that do not match the state's records
  2. 02A return selected for manual reviewNo fixing this one — it clears on its own
  3. 03A set-off that applies the refund to a debt
  4. 04A check the Postal Service returned as undeliverable

A returned check is traced and replaced as described on our NJ tax refund help page, which also covers how to check status and what the posted processing windows are.

Which return details does the Division check before paying a NJ refund?

The Division verifies income and withholding against the documents behind the return, and asks for them when they do not match.

Withholding
W-2 or 1099 withholding that does not match what the payer reported
Name or SSN
A name or Social Security number that does not match the state's records
Missing schedule
A credit claimed without the schedule that supports it

We compare the return with the documents the Division requested and correct the mismatch or supply the schedule, responding through the Online Notice Response Service where that is what the notice asks for.

How does New Jersey's SOIL refund offset work?

Under the Set-Off of Individual Liability program (SOIL), the Division applies your income tax refund and property tax relief payments to a debt before paying you the balance. The debts include:

  • Unpaid New Jersey tax
  • Traffic fines
  • Past-due child support
  • Debts to other New Jersey, municipal or federal government programs

California, Connecticut, Maryland and New York also exchange refunds with New Jersey under a reciprocal agreement.

What does a New Jersey offset notice tell you?

When an agency claims a debt and a refund is available, the Division mails you a notice stating:

The amount held

How much of your refund is being held against the debt.

Which agency asked

The agency or agencies that requested it, with contact information for each.

Your 35 days

That you have 35 days to contact the agency with a dispute or proof of payment.

The Division contacts the agency after it approves the refund, so the status can show approved before the money is diverted. The Division cannot release the refund until the agency reports the debt paid, and payment then takes up to 60 days. The agencies the Division lists include Child Support, the Motor Vehicle Commission, Probation and the Department of Labor and Workforce Development.

We read the notice, check whether the debt is valid or already paid, and deal with the agency for you.

How does New Jersey's FOIL federal refund offset work?

Under FOIL, the Division refers unpaid New Jersey income tax to the U.S. Treasury, which takes the amount from your federal refund. The Division bills first and refers last.

  1. 01
    90 days

The Division sends a FOIL bill, and you have 90 days to pay or respond

  2. 02
    60 days

If you do not, it sends a Notice of Intended Federal Set-Off, and you have 60 more days

  3. 03
    Referral

After that, it refers the debt to the Bureau of the Fiscal Service, which notifies you and sends your federal refund to New Jersey

The Bureau of the Fiscal Service also deducts a processing fee from the refund before the balance reaches New Jersey, $21.38 per transaction as the Division publishes it; the fee changes each federal fiscal year. We pay, dispute or arrange payment of the New Jersey debt inside the 90-day window so the federal refund is not taken.

Holding an offset notice or a FOIL bill?

We contact the agency, dispute or settle the debt, and act before the next set-off. Call 609-281-8096.
